Terms and Conditions of AIFluencer Market

1. Introduction

AIFluencer Market (hereinafter "the Platform") offers the creation and sale of AI-generated model images, as well as related services. By using our Platform, you agree to comply with these Terms and Conditions.

2. Services Offered

2.1. The Platform offers the following products and services:

• Pre-made AI model photo packs
• Creation of custom AI models
• Catalog expansion for real models using AI-generated images
• AI chatbot services for Instagram and Telegram
• Other services related to AI influencers

2.2. Age policy for models:

• All AI and real models represented in our services are and must be strictly over 18 years of age, without any exception.
• The Platform reserves the right to verify the age of any model at any time.
• If it is detected or suspected that a model does not meet the minimum age requirement of 18 years:
  a) The related order will be immediately cancelled.
  b) All content associated with said model will be removed from our systems.
  c) The money will be refunded to the client in full.
  d) The Platform reserves the right to take legal action if it is discovered that a client has deliberately attempted to request or provide content of minors.
• Clients have the obligation to immediately inform the Platform if they suspect that any content could represent minors.
• The Platform will not tolerate any form of exploitation of minors and will fully cooperate with authorities in case any illegal activity related to minors is detected.

This policy is unbreakable and applies without exceptions to all services and products offered by the Platform.

3. Image Rights and Exclusivity

3.1. The rights to the generated images (not to the AI model) belong to the client who purchases them.

3.2. Purchase options:

• Without exclusivity: The Platform can continue generating and selling images of the same AI model to other clients.
• With exclusivity: The Platform guarantees that no more images of that specific AI model will be generated, except for the client who has acquired exclusivity.

3.3. If a client purchases exclusivity of an AI model for which images have already been sold without exclusivity:

• No more images of that model will be generated except for the client with exclusivity.
• Previous non-exclusive sales will remain valid.

4. Creation and Delivery Process

4.1. For pre-made models, the delivery time is 3 to 5 business days.

4.2. For custom models and services for real models, the delivery time is 5 to 10 business days.

4.3. For AI chatbot services and other customized services:

• The delivery time will depend on the availability and complexity of the project.
• A system will be created specifically adapted for each client.
• The Platform will assist in selecting the best images for premium and free content.

5. Requirements and Verification

5.1. For custom models based on images provided by the client:

• The client must confirm that the images are not based on any real person or that they have the express consent of the person represented.
• The Platform reserves the right to request proof of such consent.

5.2. For services to real models:

• An identity verification process will be required to prevent fraud.
• The Platform will not generate explicit content without proper identity verification and express consent of the model.

6. AI Chatbot Services

6.1. For AI chatbot services on Instagram:

• The client must provide temporary access to the Instagram account to be automated, strictly for the purpose of setting up the chatbot service.
• The Platform will use this access solely for the purpose of configuring and implementing the AI chatbot.
• The client is responsible for ensuring that granting this temporary access complies with Instagram's terms of service.

6.2. For AI chatbot services on Telegram:

• AIFluencer will transfer ownership of the fully configured bot to the client.
• The client will be responsible for all direct charges to end users, which may include Telegram Stars or other accepted payment methods.
• The Platform will provide instructions on how to manage and monetize the Telegram bot, but will not be involved in any financial transactions between the client and end users.

6.3. Chatbot Usage Limits:

• Each AI chatbot service comes with usage limits according to the contracted plan.
• These limits may include a maximum number of messages or voice minutes.
• Once the limit is reached, the bot will stop responding to messages.
• Clients have the option to expand these limits by purchasing additional messages or voice minutes.
• The Platform reserves the right to modify the pricing and availability of additional usage at any time.

6.4. For both Instagram and Telegram services:

• The client is responsible for ensuring that the use of AI chatbots complies with all applicable laws and platform-specific terms of service.
• The Platform is not responsible for any misuse of the chatbot services by the client or end users.
• The client agrees to indemnify the Platform against any claims arising from the use of the AI chatbot services.

7. Use of Products and Services

7.1. Clients can use the acquired products and services according to the specific terms of each pack or service.

7.2. Resale, redistribution, or sublicensing of products without express authorization is prohibited.

8. Prices and Payments

8.1. The prices of products and services will be clearly displayed on the Platform.

8.2. Payments will be made exclusively through atlos.io.

8.3. The client is responsible for sending the exact amount of cryptocurrencies requested and following precisely the instructions provided by atlos.io.

8.4. The Platform is not responsible for errors in sending cryptocurrencies to incorrect networks or similar errors.

8.5. Although the Platform may try to help in case of errors, it does not guarantee that it will be possible to recover funds sent incorrectly.

9. Refund Policy

9.1. No refunds will be made once the delivery of photos without watermark has been made.

10. Client Responsibilities

10.1. Clients are responsible for the use they give to the AI models, images, and services acquired.

10.2. Clients must comply with all applicable laws and regulations when using the products and services.

11. Limitation of Liability

11.1. The Platform is not responsible for the misuse of AI models, images, or services by clients.

11.2. The maximum liability of the Platform will be limited to the amount paid by the client for the specific product or service.

12. Privacy and Data Protection

12.1. The Platform is committed to protecting users' privacy in accordance with its Privacy Policy.

12.2. Personal data and images provided by clients will be used solely for the specific purposes of the requested service.

13. Minimum Age

13.1. Users must be at least 18 years old to access and use the Platform.

14. Modifications to the Terms and Conditions

14.1. The Platform reserves the right to modify these Terms and Conditions at any time.

15. Applicable Law
